Terms of Service

These Terms of Service ("Terms") govern your use of atmg.space and any packages or services you purchase from ATMG ("ATMG," "we," "us," or "our"). By ordering or purchasing a package, you agree to these Terms and to our Refund & Cancellation Policy, which forms part of them.

ATMG is operated by Andrej Taraj - IT Company, a sole proprietorship (živnosť) registered in the Trade Register of the District Office Námestovo, Slovak Republic, No. 560-29137, IČO 54203317, with registered address at Železničná 214/21, 027 44 Tvrdošín, Slovakia. We also work from a coworking space at 25 Kent Ave, Brooklyn, NY 11249; this is not a registered office.

1. Description of Services

ATMG provides web design, web development, branding, hosting, and related digital services, offered either as fixed-price packages listed on our Pricing page, or as custom-scoped development work quoted individually.

2. Business Customers

Our services are intended for businesses and professionals. By ordering, you confirm that you are acting for business or professional purposes.

3. Orders

Before you pay, you must expressly accept these Terms and the Refund & Cancellation Policy, including that payments are non-refundable except as set out there, by ticking the boxes at checkout. We record that acceptance (date, time, and the version of the terms).
Placing an order on our website takes you to secure checkout. A binding contract is formed when your payment is completed.
If payment is not completed, no contract is formed and the order is cancelled after 7 days.
A payment made without placing an order on our website, or that we cannot match to an order, does not form a contract until we confirm it by email. If we do not confirm it, we refund it.
We may decline an order at our discretion before work begins, in which case any payment is refunded in full.

4. Prices and Payment

All prices are in U.S. dollars (USD). Prices may change for future orders; the price shown at checkout applies to your order.
Payments are processed by our payment processor, Revolut. One-time packages are paid in full before work begins.
The Hosting & Domain add-on is paid upfront for its full 12-month term ($108).
Build + Management is billed either monthly in advance ($49/month) or annually upfront ($348 for 12 months), as selected. Annual billing is paid upfront for 12 months and does not renew automatically. At least 7 days before the 12 months end, we email you the renewal price and how to renew; it renews only if you tell us in writing that you want it to. If you do not renew, the plan ends at the end of the paid term.
No automatic renewals. No fixed term renews, and no new term is charged, without your express request. The only recurring charge is monthly billing, which you accept at checkout and can cancel at any time by email (see section 10).
Custom Development projects are quoted and agreed individually before any work or payment begins.

5. Your Content

After payment, we send you a list of what we need — typically text, logo, images, and any access details. Content is "complete" when we confirm by email that we have everything on that list.
Please send your content within 14 days of payment. If we have not received complete content within 30 days of payment, despite a reminder, we may close the project. Your payment is then retained, and the project can be reopened at our then-current rates.
You confirm that you hold the rights to everything you send us, and you are responsible for the accuracy and legality of your content.

6. Delivery Timelines

Every delivery timeline starts only when both (a) your payment has been received and (b) your content is complete. Whichever happens later starts the clock.
Website in 24 Hours: delivered within 24 hours of that moment.
Website and Build + Management: 3–5 business days. Brand Manual + Website: 5–7 business days.
A website is "delivered" when we send you a link to a working preview or the live website.
Waiting for your feedback, content, approvals, or access pauses the timeline.

7. Revision Rounds

Website in 24 Hours includes 1 revision round. Website, Brand Manual + Website, and Build + Management include 3 revision rounds.
A revision round is one consolidated list of changes, sent in a single email, within the original scope of the package. Changes sent separately count as separate rounds.
Each round must be requested within 7 days of the delivery it refers to. If we receive no request within that time, the delivery is treated as accepted.
New pages, new features, new content, or a change of design direction after approval are outside the scope of a revision and are quoted separately.
Unused revision rounds expire and cannot be exchanged for money or other services.

8. Defects After Delivery

For 14 days after delivery we fix, free of charge, defects that stop the website from working as delivered.
Not defects: changes of taste or content, new features, outages or changes of third-party services, and problems caused by edits made by you or anyone other than ATMG.
Defects are resolved by fixing them, not by a refund. Refunds for failure to deliver are covered by the Refund & Cancellation Policy.
Unless the website is covered by Build + Management or active Hosting & Domain, we have no obligation to update, secure, or back up the website after delivery.

9. Hosting and Domain

Website in 24 Hours includes hosting and one domain for the first 12 months. Build + Management includes them for as long as the plan is active.
Website and Brand Manual + Website can be ordered with the Hosting & Domain add-on: $9/month, 12-month minimum term, paid upfront ($108). The term cannot be cancelled and is non-refundable.
Hosting does not renew automatically. Before the 12-month term ends we contact you; only if you tell us in writing that you want to continue, hosting continues at $9/month and you may stop it at any time with effect from the end of the month already paid.
If hosting is not continued, the website is taken offline when the paid term ends. We keep the website files for 30 days, during which you can request an export.
We register and manage the domain on your behalf during the term. Once the term is paid in full, we transfer the domain to you on request.
We may suspend hosting if a payment is not made or is disputed, or if the website is used unlawfully.

10. Build + Management

The plan includes the website design and build described on our Pricing page, hosting and one domain, software updates, backups, monitoring, and small content updates (text, images, prices, opening hours) of up to 1 hour of work per month. Unused time does not carry over. Larger changes are quoted separately.
Monthly billing: $49 per month, each month paid in advance. If a payment is not made within 7 days of its due date, we may suspend the plan and take the website offline; after 30 days, the plan ends. You can cancel at any time by a simple email to hello@atmg.space, with no reason, call, or form required, with effect from the end of the month already paid. No further payment is charged after that.
Annual billing: paid upfront for 12 months and non-refundable. It does not renew automatically. At least 7 days before the 12 months end, we email you the renewal price and how to renew; it renews only if you tell us in writing that you want it to. If you do not renew, the plan ends at the end of the paid term.
While the plan is active, you have the right to use the website. Ownership of the website transfers to you once you have paid 12 months of the plan (or one annual payment). If the plan ends earlier, the website is taken offline, and you can buy it out by paying the difference between the price of the Website package and what you have already paid for the plan.

11. Refunds and Cancellations

Payments are final except as set out in our Refund & Cancellation Policy.

12. Termination by ATMG

We may end a project or plan if you materially breach these Terms, ask us to publish unlawful content, or behave abusively towards our team, and do not remedy it within 7 days of our email notice. Payments for work already performed are retained; any payment for work not yet performed is refunded.

13. Payment Disputes

If you dispute or reverse a payment (a "chargeback"), the rights to the deliverables of that order return to ATMG until the dispute is resolved in our favour or the amount is repaid, and we may take the website offline in the meantime. Please contact us first — most issues are resolved within a day.

14. Intellectual Property

Once a package or project is paid in full (for Build + Management, as set out in section 10), ownership of the final delivered work (e.g. website files, brand assets) transfers to you. This excludes third-party tools, templates, fonts, images, or licensed assets, which remain subject to their own licences, and ATMG's own pre-existing code, components, templates, and know-how, for which you receive a permanent, non-exclusive licence to use them as part of your website. Unless you tell us otherwise in writing, ATMG may showcase completed work in our portfolio and marketing materials.

15. Communication

Approvals, revision requests, cancellations, and other notices must be sent by email to hello@atmg.space (from us, to the email address you gave when ordering). Email counts as written form. Calls and chat messages are not binding until confirmed by email.

16. Third-Party Services and Subcontractors

Delivering our Services may involve third-party providers — for example, payment processing (Revolut), hosting, or domain registration. Your use of those providers may be subject to their own terms, and ATMG is not responsible for their acts, omissions, or downtime. We may use subcontractors and remain responsible for their work.

17. No Guaranteed Results

We do not guarantee search engine rankings, traffic, leads, sales, or any other business result from the website.

18. Disclaimer of Warranties

Except as set out in section 8, our Services and website are provided "as is" and "as available." We do not guarantee that our website or delivered services will be uninterrupted, error-free, or meet every expectation not explicitly agreed in writing.

19. Limitation of Liability

To the fullest extent permitted by law, ATMG will not be liable for any indirect, incidental, or consequential damages, including lost profits or data, arising from your use of our Services. Our total liability for any claim relating to a package or project will not exceed the amount you paid for it; for Build + Management and hosting, the amount you paid in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

20. Indemnification

You agree to indemnify and hold ATMG harmless from any claims, damages, or expenses arising from your content, your misuse of our Services, or your violation of these Terms.

21. Events Beyond Our Control

Neither party is liable for a delay or failure caused by events beyond its reasonable control, such as illness, outages of hosting, payment or internet providers, or natural events. Affected timelines are extended by the duration of the event. If the event lasts more than 30 days, either party may end the unperformed part of the order, and payments for work not yet performed are refunded.

22. Governing Law and Disputes

These Terms are governed by the laws of the Slovak Republic, without regard to its conflict-of-law principles. We will first try to resolve any dispute by negotiating in good faith for 15 days. Disputes that cannot be resolved this way are decided exclusively by the competent courts of the Slovak Republic. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence or of your right to bring proceedings there. Nothing in these Terms limits rights that cannot be waived under applicable consumer protection law, including United States federal and state law.

23. Changes to These Terms

We may update these Terms from time to time. The version you accepted when ordering applies to your order.
